The constitutionality of banning same-sex marriage comes for the first time ever before a federal appeals court this week, as challenges pile up nationwide on an issue moving rapidly through the legal system. A three-judge panel of the Tenth Circuit Court of Appeals in Denver will hear oral arguments Thursday about a ruling four months ago that struck down the ban on marriage for gay couples in Utah. Utah is one of 29 states whose constitutions restrict marriage to opposite sex couples.
