Florida Republican Sen. Marco Rubio plans to introduce a bill that would delay Obamacare's individual mandate until the multiple problems in the program's Healthcare.gov website are fixed.

Rubio told Fox News' Bill O'Reilly on Tuesday that he is introducing the bill Monday because it is unfair for President Obama to penalize Americans for not buying insurance when the process to buy that insurance does not function properly.

“How can you punish people for not buying something that is impossible to buy because of the inability of this website to function because of government incompetence?” Rubio said.

Rubio’s bill will require Healthcare.gov to function properly for six consecutive months before the individual mandate can be enforced.

“Until that website is certified to be functioning, you cannot enforce this on people,” Rubio said. “It’s simply not fair.”

The individual mandate dictates every American that can afford health insurance to purchase government-approved insurance plans.
