BOISE, Idaho (Legal Newsline) – Idaho Attorney General Lawrence Wasden announced an agreement on Thursday with a Boise auto dealer to resolve allegations of harassing debt collection and repossession acts.
Wasden’s Consumer Protection Division received multiple complaints about Western Auto Sales LLC that alleged the dealership used deceptive business practices. Western Auto Sales allegedly misled a mentally-impaired consumer during the sale of a car, deceived another consumer during the transfer of a motor vehicle service contract and made threats against a third consumer, in addition to harassing his wife, during the repossession of his car.
Under the terms of the agreement, Western Auto Sales paid $950 for attorney fees and agreed to not engage in harassing debt collection or repossession acts or practices. Western Auto Sales also agreed to bring its website advertising into compliance with state and federal law, comply with the Idaho Motor Vehicle Service Contract Act in the sale of its motor vehicle service contracts, and disclose all material terms and conditions related to the receipt of a free motor vehicle service contract with the purchase of a car.
Western Auto Sales resolved the consumer complaints and agreed to pay a $15,000 civil penalty if it fails to comply with the terms of the agreement.
