JACKSON, Miss. (AP) — The state Court of Appeals has upheld the dismissal of a lawsuit by members of a church who argued they got sick after eating at a Pizza Hut in Greenwood.
The lawsuit arose from an incident on Jan. 18, 2009, at the Greenwood restaurant. That night, 19 members of St. Paul Missionary Baptist Church in Itta Bena were taken to a local hospital with symptoms including nausea, cramps and diarrhea after eating at Pizza Hut.
A state Department of Health laboratory analysis revealed little about why patrons become ill.
A Leflore County Circuit Judge dismissed the lawsuit against three Pizza Hut employees in 2012 on grounds the same issues were raised in an unsuccessful federal lawsuit against the owners of Pizza Hut.
The Appeals Court agreed in its ruling Tuesday.
