A New Mexico judge ruled in June that a website linked to Garcia, a former University of New Mexico president and a retired New Jersey physics professor, was legal. The ruling complicated the case for New Mexico prosecutors, who were preparing to present to a grand jury their case against Garcia and retired Fairleigh Dickinson University physics professor David C.
