Ind. AG files amended complaint against Tippecanoe Waste Removal

LAFAYETTE, Ind. (Legal Newsline) – Indiana Attorney General Greg Zoeller filed an amended lawsuit on Tuesday against a former Lafayette-based waste removal company for allegedly using corporate funds to pay for personal expenses.

On January 30, Zoeller filed a lawsuit against Tippecanoe Waste Removal Inc. for allegedly failing to collect trash after taking upfront payments from its customers. The amended lawsuit names owners Melissa Kanable and Kurt Kanable as defendants, in addition to TWR, for allegedly using corporate funds to pay for child support, groceries and other personal expenses.

“Customers who have been impacted by this business’s abrupt shutdown should know that my office continues to diligently pursue this case and restitution for consumers,” Zoeller said. “The allegations regarding the co-mingling of corporate and personal funds are certainly of significant concern. My office intends to hold those that were personally responsible for consumer losses accountable. This action today is a step toward finding where the consumers’ payments went and identifying any assets that could go toward consumer restitution.”

In January, TWR posted a message on its website that the company would be shut down and all its accounts would be transferred to a company known as Waste Management. Waste Management allegedly never acquired the accounts and payments already made to TWR were not honored.

Zoeller’s office received complaints from 766 consumers alleging they paid TWR for waste removal services that were never delivered. Consumers who are part of the lawsuit alleged losses between $10 and $231 for a total of $47,160.

The lawsuit alleges TWR violated the Deceptive Consumer Sales Act and seeks consumer restitution, a permanent injunction, civil penalties and attorney costs.
