The Associated Press reported that D.C. Superior Court Judge William Jackson said he didn't think he had the authority to order the search for Latisha Frazier's body and sided with police and prosecutors, who argued that the search would endanger officers and have little chance of success.
A public defender for Brian Gaither, one of the five people charged with kidnapping and killing 18-year-old Frazier, had requested that Jackson mandate the search at the Chesterfield County landfill. He argued that the body could be an important piece of evidence for the defense.
Prosecutors have argued that searching landfill could take months and cost millions of dollars, and that Gaither could be lying about the location of Frazier's body.
