Prince William Co. sues Department of Homeland Security

Prince William County has sued the Department of Homeland Security, seeking records on illegal immigrants that local law enforcement has turned over to Immigration and Customs Enforcement.

County officials requested records on Carlos Martinelly-Montano, an illegal immigrant who Prince William law enforcement officials turned over to ICE about two years ago, but DHS has not delivered the reports.

Prince William County Board Chairman Corey Stewart said the county has grown frustrated by the department’s repeated delays and failures to turn over records the county has requested.

"I've completely lost confidence in that agency," Stewart said previously. "They have done nothing but stonewall. They can't do their job, and they can't even release a damn report."

Martinelly-Montano was released by ICE while he awaited his deportation trial. During that time, he was charged with drunken driving in a fatal crash that killed one nun and left two others injured. He had two previous drunken-driving convictions.

The county Board of Supervisors voted in February to sue DHS to obtain the records, and are also seeking a congressional investigation into the department’s handling of its immigration records.
