Updated at 3:14 p.m. The U.S. Attorney's Office for the District of Columbia says that they have declined to prosecute the case.

D.C. police have arrested a man they say used a pellet gun to shoot and shatter windows on two school buses. Police spokesman Araz Alali said one student was aboard one of the buses, which is used to transport students with special needs, but no injuries were reported. Staff members were present on both buses.

James Doby, 21, was charged with multiple counts of assault with a dangerous weapon for the two incidents, which happened at about 5:20 p.m. and 5:37 p.m. Tuesday on the 3300 block of 18th St. SE. The Office of the State Superintendent of Education immediately reported the incidents to police.

Police said that it appeared that the buses were in transit at the time of the shooting, but could not say whether they were moving or stationary.
