New Mexico GOP wins campaign finance case

Republicans in New Mexico won the latest salvo in the battle over campaign finance reform when a federal court ruled in their favor today in a case on that state's campaign spending law.

The 10th U.S. Circuit Court of Appeals affirmed a lower court's preliminary injunction blocking the state from limiting contributions between political parties and political action committees. The case hinged on whether PACs not formally affiliated with parties could take in unlimited contributions for independent spending.

State law had limited the practice to prevent the appearance of corruption. State Republicans said that went too far.

"The Tenth Circuit thereby joins every circuit that has issued a published opinion on the subject. This includes the Second, Fourth, Fifth, Seventh, Ninth, and District of Columbia circuits," said James Bopp, a conservative lawyer who specializes in campaign finance issues.
