The Mississippi Supreme Court has denied a rehearing request in a depraved heart murder case in Lowndes County.
WTVA-TV reports (http://bit.ly/yXmtTv) that Rennie Gibbs was indicted by a Lowndes County grand jury in 2007 after prosecutors presented an autopsy finding showing her unborn child died of cocaine toxicity in 2006.
Gibbs asked a judge in 2009 to dismiss the indictment because she was charged with a crime not listed in state law. The circuit court judge denied the motion.
A three-judge Supreme Court panel in 2010 gave Gibbs permission to challenge the indictment. Last October, the Supreme Court said it made a mistake and the issues raised by Gibbs could be addressed in a future appeal ? if there is one.
The case goes back to Lowndes County for trial.
