No death penalty in slaying of Maryland mom, son

Montgomery County prosecutors have agreed not to seek the death penalty against a Germantown man accused of killing his wife and beating his 11-year-old stepson to death with a baseball bat.

Stefanie McCardle, the defense attorney for Curtis M. Lopez, revealed the decision during a pretrial hearing Tuesday, the Associated Press reported.

Lopez's wife, Jane McQuain, was killed with a 30-pound weight in her apartment in October 2011. Her son, William McQuain, was found in Clarksburg days later.

Authorities allege Lopez killed the child with a baseball bat.

Surveillance video from a nearby gas station showed Lopez leading William into the woods, authorities said.

Lopez was arrested at a motel in North Carolina. Police used cellphone data to track Lopez's movements.
