NY court backs business tax breaks


ALBANY, N.Y. (AP) — A New York court has reversed the state's tax tribunal and concluded that two businesses are entitled to tax exemptions on service trucks and leased rail cars under the state economic development program.

The Appellate Division says American Rock Salt Co., which operates a salt mine in Livingston County under an arrangement with the county Industrial Development Agency, can apply its state sales tax exemption to 600 railroad cards used for shipping from the mine to locations throughout the U.S.

In another case, the court says Rochester roofing company Elmer W. Davis Inc. can apply its sales tax exemption used for renovations also to trucks used on jobs inside and outside Monroe County.

The tax breaks are estimated at $450,000 for the rail cars and $20,000 for the trucks.
