Proposed Mashpee oyster farm wins legal victory

MASHPEE, Mass. (AP) — A man who wants to start an oyster farm off the coast of Mashpee over the objections of some area homeowners has won another legal victory.

The Supreme Judicial Court has declined to weigh in on the claim that the Cape Cod Commission must review the aquaculture project because it is a commercial development, an argument rejected in May by the state Appeals Court.

Some neighbors whose homes overlook Popponesset Bay challenged the town's awarding of permits, saying the 1.9-acre oyster farm posed a safety concern and would spoil their views.

Richard Cook, who wants to operate the farm, tells the Cape Cod Times (http://bit.ly/1oGcoOa ) he's pleased with the SJC decision and thinks he can start farming oysters next year.

A lawyer for the homeowners refused comment.
